How we use it, and our lawful bases
Data protection law says we must have a lawful basis for each use of your information.
| What we use it for | Lawful basis |
|---|---|
| Answering your enquiry | Taking steps at your request before a contract, and our legitimate interests in replying to you. For any health information you choose to include, UK GDPR Article 9(2)(h) and the Data Protection Act 2018, Schedule 1, Part 1, paragraph 2: the provision of health or social care. |
| Registering you and providing our services | Performance of a contract. For health and genetic information, UK GDPR Article 9(2)(h): the provision of health or social care. |

| Protecting our business, including IT security | Our legitimate interests in running our business and keeping it secure, and a legal obligation |
| Marketing | Your consent for marketing from third parties, and our legitimate interests in developing our business |
| Measuring our advertising | When you send an enquiry from the page one of our adverts brought you to, we record the advert's click identifier with it. If you have agreed to advertising cookies, we keep that identifier for 90 days, so it is recorded even if you enquire later. In that case our website also shares a scrambled (hashed) copy of your email address or phone number with Google when you send the enquiry. When our team has checked an enquiry or call, we share its click identifier with Google so it can tell which adverts lead to enquiries. We do the same if you book an assessment. We include a scrambled (hashed) copy of the email address and phone number only if you agreed to advertising cookies on our website. We never use your details to build advertising audiences. We never share the content of your enquiry or any health information with advertising platforms. We rely on your consent to advertising cookies where cookies are used. We also rely on our legitimate interests in measuring our advertising. You can object to this at any time by contacting us. We will then leave your details out of anything we share with advertising platforms in future. |
Transfers outside the UK
We transfer some personal information to Athena Labs LLC, a company incorporated in the United States. These transfers are made under a signed UK International Data Transfer Agreement, are subject to a transfer risk assessment and have supplementary safeguards, including a managed virtual desktop environment. If you have a genetic test, your sample goes to Fulgent Genetics, a laboratory in the United States, labelled with a patient code only. The laboratory does not receive your name or contact details. We make transfers outside the UK only where a UK GDPR condition is met, such as a UK adequacy regulation or an approved safeguard like the UK International Data Transfer Agreement.
